On November 27th, the day before Thanksgiving, the residents at District on Oakwood received a notification that they would be required to pick up their mail and packages at the post office until further notice.
For at least one elderly, disabled, home-bound widow who relies on the USPS to deliver critical medications, that is not an option and the interruption of mail delivery poses a grave threat to her health & well-being.
According to the local postmaster, MiddleTown Property Group has been ordered to make repairs to the mailboxes, but they have failed to comply. Residential mail delivery cannot be restored to this building until the mailboxes have been repaired, but because the postal service does not own the mailboxes, they cannot make the repairs, nor can they force MiddleTown Property Group to do so.
Only a judge can compel MiddleTown Property Group to comply with their legal obligation to provide secure mailboxes into which the USPS can deliver mail at District on Oakwood. Residents have been without residential mail delivery for a month now. If the urgency with which they have addressed repairing the elevator is any indication—6+ months of being told they’re working with vendors and obtaining bids—the repairs to the mailboxes are unlikely to ever happen without intervention by the court.
If the mailboxes at District on Oakwood are not repaired and residential mail delivery fully restored by January 15, 2025, injunctive relief will be sought, not only to remedy the interruption of mail delivery, but also to repair the elevator, which has been out of order for more than six months.
If you reside at District on Oakwood and would like to have your name included if/when a petition is filed—perhaps in anticipation of taking your own individual legal action down the road or declaring yourself a member of the represented class in a future class action lawsuit—please email help@middletownpropertygroupsucks.com or text 765-273-3074 and provide your full name (as it appears on your lease) & apartment number.
Attorney General’s Investigation Still Ongoing…
I have been informed that the Attorney General’s office is set to meet with representatives from MiddleTown Property Group sometime after the first of the year. The outcome of that meeting and the ultimate conclusions of the AG’s ongoing investigation will determine what & when additional civil legal action will be taken against MiddleTown Property Group for unlawful retaliation and a documented history of warranty of habitability, covenant of quiet enjoyment, and Fair Housing Act violations, some of which date back to the winter of 2022.
Whether or not the interruption of residential mail delivery is included in the laundry list of legally actionable claims for which injunctive relief and maximum compensatory & punitive damages will ultimately be sought is completely dependent on what MiddleTown Property Group chooses to do next. If residential mail delivery is fully restored by January 15th, interfering with the ability to receive mail will not be among the claims for which restitution will be sought when a lawsuit is inevitably filed.
It is in MiddleTown Property Group’s short-term financial and long-term legal interest to repair the mailboxes at District on Oakwood and ensure that residential mail delivery is fully restored no later than January 15, 2025.
UPDATE: While residents did not receive notification that USPS mail delivery had been restored, residents began receiving mail and packages again on or around January 25th, 2025. A mass text was sent to all residents at District on Oakwood on January 27th, 2025 informing residents that USPS mail delivery had been restored, after this MTPG SUCKS Facebook post on January 26th:
Seems MiddleTown Property Group may be actively monitoring the MTPG SUCKS Facebook page…
